E’town man arrested for assault at restaurant

An outburst at an Elizabethtown restaurant late Wednesday afternoon has led to multiple charges, including felony assault.

Winston Banks, 24, of Eliza­beth­town arrived at Sonny Boys Backyard BBQ Restaurant on Commerce Drive intoxicated and entered a restroom, causing damage of about $900 to the restroom toilet, sink and pipes, according to police.

While restaurant management attempted to contain Banks with the Elizabethtown police units en route, he struck a man in the mouth and also separated the man’s shoulder in an altercation, according to an arrest citation. The man was taken to Hardin Memorial Hospital in Elizabethtown for treatment of injuries.

According to the report, Banks had a blood-alcohol level of .148. The legal limit is .08.

He is charged with second-degree assault, a Class C felony punishable by five to 10 years in prison, if convicted, and misdemeanor charges of second-degree criminal mischief; alcohol intoxication in a public place and theft by deception including cold checks less than $500.

He is lodged in the Hardin County Deten­tion Center in lieu of a $25,000 cash bond. He is scheduled to appear Sept. 22 in Hardin District Court.
